TERMS

Hi there, we are MSH District Inc., Creators of Make Sh*t That Sells (herein referred to as “MSH District” or “we” or “us”). We’re so excited to work with you!

Before you dive into MSH District website (the “Site” or “Website”) and all the awesome benefits that come along with it, we would appreciate you taking some time to read the Terms of Use (the “Terms”) that govern your use of MSH District site.

By purchasing Make Sh*t That Sells, you are agreeing to these terms. If you do not want to agree to these Terms, you should not purchase Make Sh*t That Sells.

Program

If you are under 18 years old, you need your parents’ permission before purchasing Make Sh*t That Sells and gaining access to the Site.

Your purchase of Make Sh*t That Sells is non-transferable.  You are forbidden to share the link with anyone else. You must use reasonable efforts to keep this link confidential.

Payment is a one-off fee which is detailed on the Site’s sign up page.  We do NOT offer refunds. You will receive future updates to the program as part of your “lifetime access,” which means that you will have access for as long as we are running and updating the program. Your access to all content and all areas of the Site will be suspended or cancelled if we do not receive your payment in full.

Availability and Use

MSH District website will usually be available 24 hours a day, seven days a week.  We may, however, need to interrupt or suspend your access to the Site or the provision of the Site’s services and content, for maintenance, technical or other reasons.

When accessing and using the Site and its services and content, you must comply with directions, instructions or protocols posted on the Site.

We are pleased to be able to offer a wide range of exclusive content on the Site for your educational and learning needs. The content will be updated, changed or removed from time to time, at our discretion, so we can’t guarantee that specific content will always be available on the Site.

Content Rights

Each item of Content (Content) is owned by MSH District Inc. except when otherwise attributed. We own all other rights in the Site including its design, and look and feel.

Your payment gives you a revocable, non-exclusive license to use the Content for personal purposes.  You may not redistribute Content.

You may use the worksheets that are part of Make Sh*t That Sells for your own use, but you may not redistribute the files or assets.

The trademarks and logos displayed on the Site are, unless otherwise stated, owned by MSH District and others, and you may not use these without the approval of the relevant owner.

Fair Use and Prohibited Conduct

You are permitted to download Content to your computer as part of the program, but this is subject to a ‘fair use’ policy.  Our ‘fair use’ policy requires that your use of the Site and the Content must be fair, genuine and reasonable.

You also must not:

  • Use a false email address, impersonate others, or misrepresent your affiliation with others;
  • Engage in automatic gathering of information from or through the Site;
  • Attempt to interrupt or alter the Site’s operation in any way;
  • Use the Site or the Content in a way that violates applicable law, that violates third party intellectual property or other rights, or that is, fraudulent, obscene, offensive, or defamatory; or
  • Copy, distribute, transmit, modify or otherwise exploit the Content or any other data or code made available through the Site.

Intellectual Property Complaints

General Rules

We reserve the right, but are not obliged, to monitor all matter posted to the Site.  We are not responsible or liable for material posted by others.  We do, however, reserve the right to edit, refuse to post, or to remove matter that in our discretion is objectionable or in violation of these Terms, our policies or applicable law.

You must not upload or post any materials that:

  • Restrict or inhibit others’ use or enjoyment of the Site;
  • Are false, misleading, fraudulent, unlawful, abusive, harassing, defamatory, obscene, vulgar, or offensive;
  • Infringe others’ rights, including privacy or intellectual property rights;
  • Slander or otherwise defame MSH District Inc.
  • Contain a virus, spyware, or other harmful component; or
  • Contain commercial solicitation or ‘spam’ of any kind.

We have the right to terminate your access to Make Sh*t That Sells and website if any of the Terms in this agreement are violated.

Personal information that you disclose may be used by MSH District, its agents and contractors in relation to your purchase and the Site, including marketing activities for the Site.

We may disclose any personal information as necessary to satisfy any law, regulation or government request.

We adopted this Privacy Policy to further the relationship between our customers and us. This statement of our Privacy Policy makes disclosures concerning our collection of information, including personal information, when you use the Website, and how we use and disclose it to others. By using the Website you accept the practices described below:

Information We Collect

We collect personal and non-personal information when you provide it to us in the course of signing up for Make Sh*t That Sells and using our Website. The personal information that we may collect includes: your name, mailing address, phone number, email address, credit card number, and financial information. Application of Privacy Policy When You Access Third Party Websites

You will be able to access third party websites directly from the Website. This Privacy Policy does not apply when you access third party websites. We cannot control how third parties may use personal information you disclose to them, so you should carefully review the privacy policy of any third party website you visit before using it or disclosing your personal information to its provider.

Children’s Privacy

To access or use our Website, you must be 18 years old or older and have the requisite power and authority to enter into this Privacy Policy. Children under the age of 18 are prohibited from using the Site.
